Real Estate / Residential

Whether buying or selling, there is no real estate deal in New York State without both parties signing the contract. Do not let a meeting of the minds become a changing of the minds. As a former New York City real estate broker myself, I understand that quick contract turnaround is essential to getting the deal on the way and ultimately closed.

My experience as former counsel to the Southampton Town Trustees and Southampton Town Conservation Board allows me to keep a keen eye on resolving land use issues before they become problems.

Real Estate / Commercial

As with residential real estate, there is no real estate deal without the signed contract.  Does the contract comply with what your commercial needs are? Does the property permit the use that you need?  Is it environmentally compliant?  These are a few of the questions which need to be addressed even before signing.

With my extensive commercial client experience, we will address these and all other issues to ensure that the space you are purchasing is going to bring you piece of mind and prosperity.

 

Leasing

Does the property you are leasing have a rental permit?  Does it have the correct certificates of occupancy and compliance for your use? Is the Landlord asking for all of the money up front? Do you have dock permits in place for your boats?  A sea of issues can lie before you when leasing a property.  I will be able to navigate you through these issues and arrive where you need to be.

 

Short Sales

A short sale is when the bank that has the mortgage agrees to sell the house for less money than is owed on the mortgage.  If you have negative equity in your house, this may be the best alternative.  I will ensure that you can walk away from the house and mortgage free and clear and that the bank will not continue to pursue you.

 

Foreclosure Defense / Loan Modifications

If you are served with papers for a foreclosure this is the same as being served with papers for any other lawsuit.  You must answer within twenty days if you are served personally or thirty days if served any other way.   The time and the manner of your answer are critical.  Proper defenses must be set forth and each and every issue in the complaint must be addressed.  I have handled dozens of foreclosures and can ensure that you are protected and your bank must follow the proper procedures.

Once that answer is submitted, I will make a motion to have the matter placed before a judge in the foreclosure part of the Supreme Court in the appropriate county.  We now can start the loan modification process. With my litigation experience and loan modification expertise we can show the bank that it is not worth it for them to continue to litigate and try to own the house.

Criminal Defense / DWI

When you are arrested you have the right to remain silent.  This is a true and actual right.  You do not have to talk to the police.  The next person you talk to is of vital importance – it needs to be your attorney.  It is imperative that you choose an attorney who is fluently versed in the intricacies of The Vehicle and Traffic Laws and Penal Laws of New York State.

 As a former Assistant District Attorney on the East End of Long Island and as a practicing Criminal Defense attorney based in Southampton, I have an intimate and functioning knowledge of the Courts, Judges and Prosecutors in Suffolk and Nassau Counties.  Choosing an attorney who is familiar and comfortable with the environment and workings of the Courts gives you a distinct advantage in mounting a defense for your case.

 

Town Code Violations

 If you are served with a criminal summons for a Town or Village Code violation most likely you are being charged with a misdemeanor crime.  This means a punishment of up to a year in jail and fines as high as $10,000.00.

 As a former Assistant Town Attorney for Southampton Town, I prosecuted many of these cases.  As a defense attorney, I have defended many more. It is important that these charges are taken just as seriously as any other criminal charge and that your attorney has the experience and knowledge to defend you.

 

Wills, Trusts, Estates, Probate

If you do not have a will your property will pass intestate.  This means that the laws of the government will decide how your estate shall be distributed.  Every person should have at least a basic estate plan.  This includes a will, a health care proxy, a living will and a power of attorney.  Estate planning with particular trusts can also serve as a way to protect your assets and reduce the cost of probating the estate.  These are simple steps that I can guide you through so you and your estate can rest in peace.

 

If a loved one passes the estate must be probated.  This means that proper documentation must be filed with the Surrogate's Court in the county of the deceased.  I will ensure that the proper steps are followed in an expeditious manner so that the estate is distributed quickly and efficiently.
